 SOACP Certification Agreement 
This is a legal agreement between you and SOA Systems Inc. The agreement is comprised of the terms and conditions described on this page and is inclusive of the logo and credential usage guidelines described on the Logo & Credential Guidelines page. Please ready this agreement carefully. You can only accept a certification and the related use of credentials and logos if you agree to the terms and conditions in this agreement and the guidelines described on the Logo & Credential Guidelines page. By accepting any certificate issued by SOA Systems Inc. you are agreeing to the terms and conditions in this agreement. If you do not want to accept this agreement, then please promptly return the certificate to SOA Systems Inc. (at Suite 708, 1155 West Pender, Vancouver, BC, Canada, V6E 2P4) within 30 days of receipt, along with a signed letter indicating that you are not entering into the SOACP Certification Agreement. Non-Disclosure All SOA Certified Professional exams, including the content and wording of exam questions, constitute proprietary and confidential information belonging to SOA Systems. If you complete or gain access to any SOA Certified Professional exam, you agree to preserve the confidentiality of the exam contents. All course materials received by you from SOA Systems, its licensed trainers, or authorized third parties are protected by copyright and are intended for your internal use only. If you need to use these materials outside of your organization, you must obtain written permission from SOA Systems (or, in the case of text books, from the copyright holder). Trademarks As a certified SOA professional you may be granted use of logos and credential titles. You may only use logo(s) associated with the credential title(s) that correspond to your obtained certification(s), as documented in the permanent record issued to you by SOA Systems Inc. You may use the logo and credential title only as described on the Logo & Credential Guidelines page and only in association with your certification title, as authorized by SOA Systems. You agree, at SOA System’s request, to stop using any promotional material that misrepresents the SOACP program, as determined by SOA Systems. Warranty The products and services provided in relation to the SOA Certified Professional (SOACP) program are provided “as is”. SOA Systems, its licensed trainers, or any other authorized third party, disclaims all warranties, whether express or implied, including the implied warranties of merchantability and fitness for a particular purpose. Any certification or products or services that you receive from SOA Systems Inc. or in relation to the SOA Certified Professional program does not guarantee that you will be eligible for employment of any kind. Liability In no event shall SOA Systems be liable to you or any of your clients for any indirect, consequential, incidental, or special punitive damages, or any loss of business profits, revenue, data, or data use arising from or related to your certification or completed courses, your inability to obtain certification or complete courses or exams, or related to the termination of your certification, even if SOA Systems has been advised of the possibility of such damages. SOA System’s maximum liability for any damages arising out of or related to your purchase of courses, courseware, books, or exams, whether in contract or tort, or otherwise, shall be limited to the total fees paid by you to SOA Systems Inc. Termination You may terminate this agreement with 30 days notice by sending a signed, written letter to SOA Systems Inc. at Suite 708, 1155 West Pender, Vancouver, BC, Canada, V6E 2P4. SOA Systems Inc. may terminate this agreement with 30 days notice but may also opt to terminate this agreement immediately if there is a breach of the agreement (including the conditions provided on the Logo & Credential Guidelines page) on your part. Governing Law This agreement is governed by the laws of the British Columbia, Canada. | |
